Terms and Conditions- Applies to family sessions, engagement sessions, maternity and newborn.
A 50% session fee and accepted terms and conditions are required to secure your date, the remaining must be paid in full, no later than 7 days prior to your session. Failure to do this, could result in loss of services.
Should the client need to change the date of their session they will not lose their confirmation fee as long as a minimum of 14 days (before the original session date) is given. This only applies when date is transferred with Heart and Soul. If the client cancels Heart and Soul’s services for any reason within 7 days of their session they will be liable to pay the full amount of the session unless the date is transferrable.
In the unlikely event the photographer is unable to perform to the guidelines of this contract due to an injury, illness, act of god, act of terrorism or other cause beyond the control of the Heart and Soul (including Covid-19 or other such pandemics), every effort will be made by Heart and Soul to secure an associate to perform photography services on the day, if this is not acceptable by the client then the client will forfeit their booking fee and Heart and Soul shall have no further responsibility or liability to the client.
The copyright of all works created shall belong to Heart and Soul in accordance with the Copyright Act 1994. All files remain the exclusive property of Heart and Soul and must not be modified in any way. Heart and Soul will continue to hold the copyright to all digital images if files are purchased. The client is authorized to make unlimited personal reproductions of the images ONLY if they purchase the digital files, however NO third party sale or commercial usage is permitted without full written permission from Heart and Soul. Reproduction includes, but is not limited to, scanning, downloading, right clicking, emailing, posting on websites or blogs, photocopying or printing in any manner. Film negatives remain the property of Heart and Soul Photo unless otherwise discussed.
Please note all parties are responsible for their own personal safety during the physical session. The client agrees to the photographer’s artistic interpretation of each image taken. Failure by the photographer to take any or produce any specific photograph shall not be reason or cause for the client to make claim for such missing photography, as long as sufficient photographs have been taken for the session booked. Client must allow sufficient time for photo session, failure to do so may not result in specific photographs. In the unlikely event that digital/film files have been lost, stolen or destroyed for reasons beyond Heart and Soul’s control, including but not limited to, camera, hard drive, or equipment malfunction, Heart and Soul’s liability is limited to the return of 50% of the fee (excluding the booking fee) received for the event. Heart and Soul is not liable for the loss of images subsequent to the final delivery of all products included in the package. Due to the nature of film and the added risk of film development and third party involvement (i.e film rolls will be sent off site to be developed as I do not do this myself), I cannot guarantee the results, however every care will be taken to ensure this does not happen and the risk of this is low.
Heart and Soul shall have the exclusive right to use and make reproductions to promote business for, but not limited to, photographer’s portfolios, website images, awards, marketing displays, competitions, social media, and advertising. If the client specifically does not wish for any images to be used for the above purpose/s please specify this when booking your session.
